Yachts Terms & Conditions

Insurance:

All Mykonos Monogram boats are insured against risks arising from liability to third parties and damage to hull, machinery, and sea pollution liability.

Fuel: Petrol consumption for above suggested itineraries have been based on total miles to cruise and on a 24 knots cruising speed as well on today ‘s petrol market rate.
Yacht will be rendered to client full tank and should be redelivered from client full tank. Should for any reason, petrol consumption exceed the estimated consumption, client will have to compliment on petrol cost (altered itinerary, weather condition, etc.).

Windy Conditions / Daily charters in Mykonos Area:

In case of windy conditions (up to 5 beaufort all charters will depart from a southern beach where winds do not affect the coast and the course of a comfortable and enjoyable cruise. Charterer will be informed should a departure from a Southern coast be necessary.

Port Authority Charter Party Document:

All names as per passport and passport numbers should be provided 2 days prior to embarkation date as to prepare Charter Party Document.
The Charter Party Document (Mykonos Port Authority requires all names and passport no. of guests on board) shall be signed in the morning or eve of departure by the Captain and Port Authority, giving the right to the charter to depart. All names, nationalities & passport numbers should be available to boat representative, two to three days prior to set date of embarkation & sent per email.

Should weather not permit departure and authorization denied, all amounts deposited are returned to client. Should client not appear on date of embarkation, Yacht representative is entitled to retain full amount of charter fee on behalf of owner.

Should client decline to embark for any reason and authorization for charter departure given by Port Authorities, owner’s authority representative, will retain full amount of charter.

APA definition / for weekly cruises and /or outside of Mykonos area

The Advance Provisioning Allowance (APA) is designed to cover the operating expenses of a charter such as, fuel (for the yacht, her tenders and motorized water toys), food, drinks, land services, electronic communications, canal fees, harbor dues, local taxes and marina fees outside Greek waters, or private marinas. Depending on the number of guests, type of yacht and duration of charter, the APA is calculated between 25% and 35% of the total charter fee. APA is due at the time of the final charter payment. 
These funds for weekly charters will be given to the captain before the start of your charter. He will ensure that your yacht is fully fuelled and provisioned when you step on board. Whilst an up-to-date summary of accounts can be requested at any time during your charter, your captain at the end for the cruise will normally submit a full set of accounts. If, during the charter, the expenditure exceeds the sum already paid, additional cash funds will be required at once. All outstanding bills should be settled in cash before final disembarkation. Of course, any remaining credit at the end of your charter will be reimbursed to you in full.
For daily set charters in the Mykonos area or nearby islands, the petrol consumption (APA) is calculated according to miles required for the set suggested itinerary and petrol cost included in the total charter price according to petrol daily market rate. Should the itinerary change in the course of the charter upon client request, our captains will inform our clients accordingly should there be an additional petrol consumption to settle. For more than a day charter (one night two days, and charters less than 7 days), Yachts are rendered to client full tank, and should be redelivered by client full tank.

CANCELATION POLICY

In the event of cancellation of the charter by the Charterer, for any reason, the following cancellation policy will apply depending on the time-interval between the booking confirmation and the cancellation date:

a. Policy of “Dossier’s expenses” (150 euros minimum) will be applied for bookings cancelled in time period up to 90 days prior to boat embarkation.

b. Cancellation fee of 30% of the total charter fee, for bookings cancelled within a period of 90-60 days prior to boat embarkation.

c. Cancellation fee of 50% of the total charter fee, for bookings cancelled within a period of 60-30 days prior to boat embarkation.

d. Cancellation fee of 100% of the total fee, for bookings cancelled in a period less than 30 days prior to boat embarkation.
In case that the yacht under cancellation is re-chartered to another Charterer for the same period and under the same conditions only the dossier expenses will be charged.

Force Majeure

If by reason of “force majeure” the owner fails to deliver the yacht, the charterer is entitled to treat the agreement as terminated. The charterer’s exclusive remedy will be to receive repayment without interest of the full amount of payments made by him to the owner or Broker(s). Alternatively if the parties mutually agree and subject to the bookings of the yacht, the charter period shall be extended for a period equal to that which shall have elapsed the date of delivery and the date of the actual delivery of the Yacht.

Water sports 
(toys) are allowed only under certain conditions and always upon captains’ discretion without the need of justification. Conditions taken into consideration are:
Marine traffic (boats, jet skis, surfers, etc.)
Wind
Waves
Proximity to swimmers
Topography and local conditions (shallow reefs, currents etc.)
No usage prior consummation of alcohol
Speed boat or Jet Ski license. Use of personal watercraft is only permitted subject to the operator having the appropriate license and meeting local regulations. Any liability arising from non-compliance is entirely at operator’s risk. Usage of Jet Ski should clients not have the required documents will be left to Captain’s discretion.

Customer Behavior


You must accept responsibility for the proper conduct of yourself and any members of your party. Mykonos Monogram cannot be held responsible for under age consumption of alcohol. We reserve the right in our absolute discretion to terminate without further notice the holiday arrangements of any client who refuses to comply with the reasonable instructions or orders of the company staff, agent or other responsible person whose behavior in their opinion is likely to cause distress, damage, danger or annoyance to other customers, staff, any third party or to property.
Observance of Customs and Diving Laws
Not to allow any person on board to commit any act contrary to the customs laws of Greece or of any country or contrary to the laws permitting to fishing or underwater fishing nor to seek and/or take possession of objects of archeological nature or value and that in case any such act is committed this Agreement shall thereupon terminate, but without prejudice to any right of the owner or the company who represents him , that the Charterer shall carry alone any resulting responsibilities and he shall answer alone to the appropriate authorities.

Ascertainment of the Damage
If any accident or damage is caused by the Yacht, the Charterer shall request from the nearest port authority to ascertain the damage or accident and the circumstances in which it has been caused and to make a written record and statement about it and he shall notify the owner at the same time.
Governing Law
This agreement will be governed by Greek Law and any disputes will be dealt with by the Greek courts.
